# ¿Qué estados exigen licencia para la limpieza biopeligrosa?

Muy pocos. La mayoría de los estados no otorga licencias a la limpieza de trauma como oficio propio y regula los residuos: quién puede transportarlos y dónde tratarlos. California y Florida son los dos que hemos confirmado, y lo hacen de formas completamente distintas.

## La suposición que conviene abandonar

Las familias suponen, con razón, que un trabajo tan serio debe requerir licencia, y que una empresa con licencia está por tanto verificada. Ninguna de las dos cosas suele ser cierta, y la segunda no lo es ni siquiera donde la primera sí: que un estado registre a una empresa no significa que responda por su trabajo.

**California** es el caso estricto. Una empresa debe registrarse ante el Departamento de Salud Pública como profesional de residuos de escenas de trauma **antes de comenzar el trabajo**, con contrato demostrado con un transportista registrado y una instalación de tratamiento autorizada. El registro es por dirección comercial, y la renovación exige comprobar la eliminación del período anterior.

Este llega directo a su bolsillo: **el programa de compensación de California solo reembolsa la limpieza realizada por un profesional registrado.** Contratar fuera de esa lista puede anular un reclamo por lo demás válido.

**Florida** regula de forma indirecta. El Departamento de Salud no otorga licencias de limpieza de trauma ni regula procedimientos. Sí exige el registro como transportista de residuos biomédicos a quien transporte 25 libras o más desde una escena a la vez, y operar sin él infringe la ley estatal. El propio directorio estatal de transportistas registrados señala expresamente que no avala los procedimientos de limpieza — estar en esa lista significa que una empresa puede transportar residuos legalmente, y nada más.

## Lo que no le decimos

Encontrará páginas que enumeran estados que “otorgan licencias” para este trabajo, a veces nombrando Minnesota e Indiana. **No pudimos confirmarlo en fuentes estatales primarias, así que no lo repetimos.**

Eso deja esta matriz incompleta, y preferimos que esté incompleta a que esté equivocada. Hasta donde alcanzamos a ver, no existe en internet una matriz de 50 estados debidamente documentada sobre esto. Construirla con rigor, estado por estado desde fuentes primarias, es trabajo que estamos haciendo y no trabajo que afirmemos haber terminado.

Los estados que aún no hemos verificado aparecen arriba con su agencia y su enlace, sin página propia. Un estado sin datos confirmados no tiene lo suficiente que decir para sostener una página distinta de las otras cuarenta y ocho, y publicar cuarenta y nueve páginas casi idénticas sería peor que no publicarlas.

## Qué revisar cuando su estado no exige nada

La ausencia de una licencia no le deja sin comprobaciones:

- **¿Quién transporta los residuos y dónde se tratan?** Todos los estados lo regulan de algún modo.

- **¿Los técnicos que asistirán tienen la certificación TCST del IICRC?** Las credenciales voluntarias pesan más donde el estado no fija un mínimo.

- **¿Puedo ver su plan escrito de control de exposición y sus registros de capacitación?** Es una exigencia federal para cualquier empleador que haga este trabajo.

- **¿Emiten un certificado de tratamiento?** Su reclamo lo necesitará.
